Cannabis Retailers?

Governor Newsom declares cannabis retailers as essential!

States have issued orders mandating that everyone aside from essential workers stay home as most businesses are forced to temporarily close in an effort to slow the spread of the coronavirus.  California has produced a list of “Essential Critical Infrastructure Workers” effective March 22, 2020 including most every profession (other than those working in tattoo parlours and bordellos).

And it is true, cannabis retailers are listed on page 1 of 14 pages under the bullet Workers in other medical facilities…. Colorado revers

Although everyone would argue that they’re essential to their employers, lawmakers have dwindled the list to several industries deemed too critical to be halted during the crisis. While states can designate what qualifies as essential, the standard definition of an essential employee is someone that performs work involving the safety of human life and the protection of property, according to the 2013 Essential Services Act.

Wait a minute!  This act has nothing to do with the general public as it was enacted to implement funding reduction (furloughing employees not essential to the operation of a Federal government agency) during the sequester that was ordered on March 1, 2013 to enforce 251A of the Balanced Budget and Emergency Deficit Control Act of 1985.

Social distancing is important to slow the effects of coronavirus, however, President Trump is giving states their free will to establish rules for stemming the coronavirus. The long term health and safety of our nation may preclude these extreme effects on our nations workers. that each state and even areas within each state have particular needs during this pandemic.

Hmm.  That is called the System of Federalism, the basis of our constitution.
